It could be that the law doesn’t allow for it to be rape; it’s been changing recently, but “rape” used to be “forcible vaginal penetration” - anal rape wasn’t a thing, and being “forced to penetrate” was just sexual assault. It’s not a mora judgement, it’s a legal thing - it may not legally be considered rape, given it’d be adjudicated under the laws from 1996.

It’s the victim giving her a “pussy pass” - no criminal complaint was made against her, they went straight to civil court. Someone else suggested it’s a statue of limitations issue; I only found the statue of limitations for civil procedures, which was abolished in Queensland. Truth be told, kid probably knows he couldn’t win in criminal court, but since civil court only requires a preponderance of evidence he took it there first. A failed attempt at criminal conviction could bias the civil jury…
