He literally says on the stand that he didn’t ask for consent before having sex with her. His entire video is blaming everything but his own actions. Was it sexual assault? He didn't make incriminating statements though, as to the charge of rape. This is factually incorrect. He was incriminated based on statements he made on the stand and in fact the judge specifically cited that in their judgement. The judge also makes a good point, his statements about her saying “f*ck me daddy” were not believable because the victim was not confronted with these statements on cross examination. Anything you say on the stand is evidence, it’s actually direct evidence in this case. It’s why every defense attorney on the planet will recommend against testifying in your defense unless you’re completely fucked without it. This was a trial by judge so the judge will specifically look at the record and examine each statement and consider it when making his judgement.
