This happened a few years ago. The brother got 30 days in juvenile detention for homicide by assault, and that was the maximum possible sentence. Because feminism isn't about equality, even though that's their only reason for it. If equality was the goal, then they would be arguing that women shouldn't be favored in domestic cases, child custody cases, divorce proceedings, et al, simply because they're seen as the weaker sex whom must be coddled. I never said it excused his actions, only said that he shouldn't have been convicted because the court disregarded the law which rightfully forces her to share the blame based on her actions. No action is without consequence and in this case her decisions directly contributed to the rape being possible.

Why? People with medically proven mental infirmities, of which they have no control over and can't change, are the people which that law was designed to protect. If an otherwise healthy adult makes the willful decision to mix opioids with alcohol, then their subsequent lack of decision-making ability (and possible negative repercussions) is their own fault.

That's not disallowing them from court. The state statute says mental incapacitation doesn't apply to someone who voluntarily took intoxicants. He's absolutely wrong for raping her, but it's a miscarriage of justice to convict him according to state statute. Also, taking narcotics with alcohol and getting into a car with strangers isn't a smart move. She shouldn't have gotten raped, but making stupid decisions is what put her in that position in this case.
