I think politically it is a no go in the United States. People don't want to "help" prisoners, as you mentioned. More laws and stricter punishments are the only thing people want when it comes to prisoners. I know there are broad definitions of conspiracy in a lot of states in the US. If you are given the details of a crime and don't report it you're guilty of said conspiracy, which carries the same sentence as the crime in my state.

The article says the man, O'Dea, signed putative father forms, but what about the rest of them. If they didn't claim fatherhood and the mother goes and puts the child up for adoption; how are the authorities even supposed to know a father existed?

I don't think Ben Garrison is someone you want to promote. He is quite the extremist and his cartoons wouldn't hold up to mainstream scrutiny. Edit: Most of the stuff you see of his is edited anyway.

I really don't know how it works. I know many reservations are autonomous and have their own police force and schools. Many illegal immigrants come in through a reservation on the Canadian border because there is no border enforcement on the Native's lands. I was going to say something about 'innocent until proven guilty,' but if the father came in during the act and then the evidence backed that up; I suppose he should't be charged with anything. Especially considering his intent was to just incapacitate the perpetrator.
