Speaking with experience in both Fidelity and TDAmeritrade as retirement brokerage vehicles, you just call them up tell them your intentions to do intra-day trading in your retirement account. They have you sign paperwork telling you the FINRA regulations and you release liability of any IRS violation you may incur from the brokerage. I'm in NJ, 2.8 year marriage, my income is a little more than yours and my ex-wifes was 35k. My advice to you is to try to settle before the ESP panel and you might not get any alimony. The moment my ex heard impartial lawyers discussing that alimony was an option for such a short marriage, she was hooked. We made it all the way to the second intensive early settlement panel before settling. Alimony was roughly 25% the gross difference between our incomes.

In NJ, there are previous legal precedents to apply pendente lite (requirement to maintain the status-quo at time of filing up until judgment) retroactively upon the conclusion of the divorce trial. This means that after 5 years, when OP goes to trial, it could be ruled that he owes any back-due pendente lite that wasn't paid. You're probably right if you're going without lawyers. To be honest, it doesn't seem like a lot of money in comparison to what it would cost to have lawyers involved, so it might make sense to attribute it to "the cost of a divorce". I know that's a hard pill to swallow. During the discussions, politely ask "Can we exchange the last few months of bank statements". You don't need to give a reason.

Hiding assets is kinda stupid in my opinion unless you plan it out well in advance and do small amounts at a time. You'd have to lie to uncle Sam come tax time to hide some pretty large assets that earn income. Furthermore, as far as I know, if your spouse suspects you of hiding something "substantial", most lawyers will suponea tax records, and do a broad property records search (they are always happy to charge more billable hours).
