This should be all her fault. It was her fault she got drunk. No one force her to get drunk, after that even if drunk, she is still responsible for her actions, even if she's not capable of doing the right thing. This is exactly like if a drunk driver ran into someone and said, "sorry I was incapable of making sane decisions". Even if "Shane" didn't stop her, that's not his fault, really he should have stopped her, but that doesn't mean he should be punished for her poor decisions.
