3	Girl Caught Shoplifting at a Store. The Fake Crying Technique didn’t work In Australia it’s not ‘illegal’ to stop someone leaving but technically it’s not theft until they pass the exit/entry. If you detain someone while still inside the store, you risk ‘unlawful arrest’ since it’s based on intent. They could argue they intended on paying for the goods, even if concealed in a bag/under a shirt/pockets etc, which can lead to lawsuits.
