1	Is it worth fighting? They should be able to baseline that as the official separation date, but absolutely make sure, you stated you have been separared already. is that when the ERD took place? Get that timer stopped ASAP. Once you hit the 10 year mark its going to become a litigation nightmare. The timing is pretty rough. Do not give her your pension, get your own lawyer. 2	Is it worth fighting? Uh yeah it's worth fighting for your retirement, are you BRS or high 3?. Are you guys legally separated? Theyre going to go off the date of separation. Get that piece ironed out. Community property state? If so she is going to get 50% of what you contributed to it during the duration of the marriage to date of separation. Obviously talk to a lawyer.
