Don’t really need to as my health insurance plan wasn’t status quo in the eyes of the court. This was years back and her attorney knew I had removed her during open enrollment because I sent him the confirmation page. Even when married, you’re not legally obligated to add the wife to your medical insurance. Maybe it differs by state, but Texas frowns upon keeping the ex spouse on their medical insurance during divorce proceedings.

My employer let me remove her during open enrollment, no questions asked. Anything done outside of open enrollment would’ve required me to provide the decree. In Texas, once the divorce is finalized, spouses are responsible for their own health insurance.

I was able to remove her during open enrollment just days after filing with no issues, they said any other time I would need to provide the divorce decree. Only reason I ever added her on was because my employer offers a medical expense card of $2500 for a married couple that can be used for medical expenses and counts towards the deductible, and whatever isn’t used by years end rolls over to the next year.

Something doesn’t seem right, in 99% of divorce cases the spouses are financially responsible for their own attorneys. Is there a court order signed by the judge stating you must pay and that you must leave the premises? If you’re working 2 jobs just to stay afloat, your income/expenses will prove that, and any judge with a moral compass of at least 50% would see that and not make you go for a 3rd job to pay your soon to be ex wife’s attorney. Like 99.99% of the comments have stated, DO NOT LEAVE THE HOUSE! A wife never just wakes up one morning and says “yeah I’m filing for divorce,” guarantee she has been thinking about it for at least the last 6 months, if not longer than that. I know, you want to be the nice guy in the situation and thinking you’re doing the right thing. What state are you in? Here in Texas, courts frown on spousal support. My now ex, tried hard for spousal support, we even went to court on it, and the judge ruled against her. So, if you’re not in Texas, then try to get residency here.

Tx here. I knew we were heading towards divorce in late 2019, however Covid delayed those plans. I used the CARES ACT to withdraw $100k from my 401k in May 2020, then took a loan from the 401k for another $100k in October. I felt I needed to match her income, so I started picking up extra shifts, the OT was to good too pass up (any hours after 6pm M-F was an additional 35%, and all day on weekends).
