Since they are married, he has paternal rights by default. Nullifying or terminating those parental rights is going to be slim to none, as the child was conceived in wedlock with the husband automatically presumed the biological father. Emotional abuse is trickier to prove in court to get sole custody. So an abortion and divorce is sadly the best outcome that could happen at this stage. It's just how I've noticed the laws work here in the states. Even if you decline to put the man's name on the birth certificate he still might suspect he fathered a child and get a court-mandated paternity test on the poor kid.
