I don't disagree with what you said. Perpetrators of domestic violence on their first offense don't necessarily get jail time either, so why should somebody else? They should get something though. Community service at your judge / justice's favourite local place might not be the best thing either, but it's far better than nothing.

So would it be fair to say that somebody who was straight for x years then decides they're done with the opposite sex that they were moulded by society to be the original way they were and that they were homosexual all along? I've seen the look in a police officer's eyes as they cuff a man and walk him to the cruiser because the letters of the law dictate their job and not because it had anything to do with the stories the victim and the accused had offered or the discretion they are otherwise typically allowed. At the end though, are you to go before a judge / justice and admit guilt? That's what happened to me after my "classes" and there was a chance the justice (in my case) could just have said. "Even though you went through the program, we still see fit to punish you". That didn't happen to me, I was granted an Absolute Discharge (no criminal record).
