I think you should sell the house, or buy her out via refinance if you are dead set on keeping the house, give her her equity, and let her go. If she moves into Replacement Dad’s house she and your kids will only be 15 minutes away, which sounds like a good case for 50:50 custody of the kids during the divorce negotiations. I have even heard of divorced parents leaving the kids in the family house while the parents take turns staying with the kids when it’s their turn to have custody. I imagine …

Why aren’t you divorced? It’s time to move that process along. Be sure your divorce decree includes specifics about who gets to claim the dependents etc. That said, I’m pretty sure the tax laws don’t say “first one to get their return turned in gets to claim the kids.”

It sounds like you're going to have to choose between your new "partner" and your son. Choose your son or you'll have bitter, bitter regrets.

Were you married? If so, will you be getting a divorce? Assuming it’s yes, your divorce decree should spell out support, custody, and visitation. If you use lawyers they can negotiate those things. Some judges will be more favorable toward you if you voluntarily supported your children while you were separated from your wife. Just out of curiosity ... I am aware that members of this subreddit are probably mostly men, and that might partly explain the negative comments about women who cheat. But, considering the original post, what about men who cheat? Aren't they just as bad as women who cheat?

Are you saying that your staff sergeant’s husband plotted against his spouse like OP’s wife did?

Your ex should have spoken up sooner If she was unhappy. Is it possible that she did, but you couldn’t or wouldn’t hear her because you were happy with the way things were going for your family? I don’t say this to make you feel bad. I’m saying it because this sort of self -reflection may make it possible to salvage your current relationship, or to at least avoid going down the same path with your next one.

When I divorced my first husband, the judge instructed us that when there are underage children, custody and support are never “final.” Either parent can sue for changes at any time.

You can kill a man, but you can't kill an idea.
