You can plan to make sure you avoid drunk driving - take a taxi, have a DD, only be drinking at home, whatever. Now with sex, that requires two to tango. Obviously if the other person is drunk as well, then that's not rape, just like how 2 kids who have sex aren't statutory raping each other.
