I think we can end this cordially. It's basically just custody of the kids, and that will be 50/50 or me taking them some more. You need to talk with a lawyer, especially one that's familiar with International custody situations, because if she remains in Spain there is absolutely no way in hell you're going to have 50/50. Is your kid a US citizen and she is not (or she is a US citz?)? You could take him back if hes a us citizen and then its US/AUS fighting it out. And if shes NOT a AUS citizen there is nothing preventing you from going back to the US with your US born son. In any event you need to talk with a lawyer familiar with international custody!! Get educated. Dont leave your kid.

You need to get a lawyer that's familiar with International custody situations. Is your child us citizen? Does your child have Australian citizenship? Does he have dual citizenship?

Unless there's something in your decree that prevents her from selling the home, you need to operate under the assumption that the second the signature is dry on the decree she could sell. Get your own appraisal done (they work for you) and something in the decree saying the house can't be sold until your kid is at least 18. Don't let the love for your kid have you doing favors for your ex. Don't think like a spouse or it WILL screw you over.

You need to get copies of her FULL paystubs to see what acounts deposits are going into. Good bet there is another account. Pull your bank records as far back as possible. Go onto a branch and ask for a personal banker and that you need as much a history as possible Run a credit report. On her as well if you can.
