At least in Canada, it isn't just anyone killing a baby. There's a strict guideline to what constitutes as infanticide and it usually has to do with a mentally unstable mother killing their newborn as a result of giving birth or something like that. The bigger debate should be whether or not we should take into account mental illness in court when someone commits a crime.
