It's kinda interesting, but a lot of the replies I'm getting from people seem to just attack/downvote what I'm saying, which is really quite hostile. That's probably true, and a really bad thing if it is. I think too many people make assumptions that other countries don't want to target them for hack attempts.

I never said that it's a defense for her breaking the law, nor did I even imply that she shouldn't get in trouble for this. What I posted is related to her intent. The original poster made it sound like that she's going out and breaking the law just because she can and doesn't care about the law at all. That's an intent thing. Did she break the law? Yes. While I totally agree with you that the choice was not a good one, I'm not entirely convinced it was malicious (e.g. "not playing by the law") As far as emails through an open network, was the smtp server also unencrypted? Last I heard, almost all SMTP servers (at least popular ones used for common email) are encrypted now. Don't think of me as excusing her, or her behavior though. Just giving her a bit more of a 'benefit of the doubt' when it comes to the intent more than anything else.

To be fair, a lot of people use personal email for their work - and even those being govt employees. It's something that people have to be reminded about - that Freedom of Information Requests apply to one's personal email too, if used for govt communication. Having multiple emails is sometimes a PITA, and sometimes it's easy to make mistakes, and it's very easy to just be lazy.
