| 1 | Rushing into a Separation AgreementWhile I agree, in some circumstances I feel like they're the same. For example, I'm in North Carolina. We have to physically separate for 1 year before we can actually divorce, so I haven't left, and we're going to mediation to try to hammer out a separation agreement. If we can't, I'm honestly not sure what the next step will be, but I know that I wasn't leaving with no separation agreement in place, at least yet. STBXW wants to separate, and has already drafted an agreement. I've spoken with 3 lawyers and they've all laughed at it, said "Do what you want, but I would never recommend anyone sign that." They've also advised not to leave the home until we have something done.
