A defense attorney's job is to provide the best defense possible, and if they don't, then guess what we get. Did you guess a fresh new trial for insufficient assistance of counsel and a malpractice lawsuit? Because you should have. If the prosecution can't prove intent, then the person gets a lighter sentence. That's how the law works, and it's by design.
