She’s wrong. She can’t legally withhold it. Nothing is “legal” until that judge/chancellor rules. Your house (joint or not) means your stuff. Agree with below; get a lawyer

🤔 Her lawyer’s duty is to operate in her best interest; your lawyer’s duty is to operate in your best interest. I’d say your lawyer failed to protect you...her lawyer may have advised her to wait until this investment profile matures a bit then try to amend the settlement. We’ve had a great market few years and she may be ready to sink claws into that money. Just saying I think your lawyer failed you on this.

Hmm... in the 🇺🇸, Retirement and investment accounts (401K, mutual funds, IRAs, etc.) are fair game for spouses to take (unless someone here wants to call out a state where that’s not the case). HOWEVER, they’re supposed to be outlined in the settlement agreement. If she’s you’re ex, then the D is final. If your lawyers skipped the investments in the original court filing, you had a bad lawyer and sloppy judge.

States vary so your lawyer is best source of advice. In my state “no fault” has to be mutually agreed upon. I knew she would dig in her heels. Custody was going to be biggest hurdle. In my state, one-way recording is allowed (I could audio record her without her consent). That’s not the case in every state. My attorney just told me to start getting dirt on her. It sounds like you and your wife are making this decision together (TX vs GA filing). That said, it doesn’t matter. Just check GA divorce law. Most states require residency for a period of time (usually 6 months if so).

Sounds like you haven’t talked to a lawyer yet. Do so. “Habitual drunkenness” is grounds for divorce in most states. That said, if your suit is based on that, you’ll get the kids 100%. No judge will give kids to a drunk (even if it’s the mother). You also need to take pics of things. There’s a lot to unpack there! Her lawyer is only fighting to prove what she’s saying. If she’s lying and the evidence shows you’re squeaky clean and transparent with your money, your legal counsel should be able to submit the evidence to counter what she’s claiming. I had a similar situation. My ex “went back for more” the following year. Ultimately the tax returns proved she was just digging (almost like when we were married 😜)

Man I drowned myself if hobbies. Probably got back into scotch tasting a little too much but I grew out of that thankfully. If you have [the] kids, get into their activities. Definitely grab a therapist even if you think you can handle things. You must find someone to talk to. Do things you always wanted to do but couldn’t because your wife wasn’t into them
