There is likely to be an eventual circuit split on the issue of whether bans on same sex marriage are constitutional and whether laws dealing with sexual orientation should be evaluated under heightened scrutiny. There is also a high likelihood of a SCOTUS retirement during the next presidential term. Third parties have no chance of winning, and the GOP is more likely to nominate anti gay judges.
