Idk even something so subtle couldve wound up losing him the fight. Not to mention he didnt know what else she would do moving forward with the fight, had he ignored it. Seems reasonable to eliminate the variable, she involved herself. Also shin kicks hurt. Had it been another man that threw that baby kick, i bet no one would have found it excessive

Disagree! If you try to frame somebody for a crime, you should be punished differently depending on what you were trying to frame them for. Its a direct representation of how badly you were trying to hurt them. If you shoot at someone you will get in more trouble than throwing a rock at them, even if you didnt hit them with either. The same principal should apply here
