I will try to make sure that she wasn't awarded an alimony. I don't think she was, but I'll try to get a hold of the actual divorce decree. I'll do everything I can to help build up some cash for a lawyer. I just graduated and am 30k in the hole. Does infidelity during the marriage count for anything? Is there any sort of legal threshold that I should try to prove that she's just doing this out of spite?

Update: Ok so I've since talked to him. He was happy to have me on his "side" as such, and we were both close to tears. But he's just gotten so fucked over that he just can't really fight anymore. His previous lawyer was a public defender, because that's all he could afford. He just feels hurt and betrayed and feels that there's nothing he can do.

Ok, IANAL, but the local judge knows and seems to like my mom. He treated her very well during the divorce and basically fucked my dad hard, on multiple occasions. She is more than willing to get her own lawyer. Honestly, it sounds to me that your mom heard that your dad was getting his shit together and got spiteful. Damn straight. She got child support, but that's done now. She is not getting alimony right now. She is employed.

I'm sorry this all broken up and jumbled. I'm trying to sort everything together in my head what's useful. He has clinical depression, and was definitely depressed at the time when he signed most of the original divorce paperwork. He is on anti-depressants now, but wasn't at the time. I don't know if alimony has to be dealt with at the time of the original divorce. They were divorced in Wisconsin.

I'm 21. My parents separated when I was 10, the divorce started sometime after that. But everything wasn't resolved until I was about 15.
