If you're on the lease she can't ask you to leave as it's your place as well. Tell her you're not going anywhere. She can leave if she wants to. I did that with my wife and our house because I'd worked on this place for years to turn it into our home. If you have children - DO NOT LEAVE. Unless there is abuse where you are the abuser she's got no reason to kick you out. Even if you cheated she can't really.

Right folks, a few of you have told me that I shouldn't spend my time and energy on this. I'm not - I vented HERE instead. :)

Yeah, It's not worth anything. I had researched it when it was passed to us. I was just like 'really?' on our conference with the mediator. When she left I let her pretty much take whatever furniture she wanted. We honestly don't have a lot and what was left was furniture my grandparents sent me from their home when they went into assisted living. The rest of it is pretty inexpensive ikea type stuff. Our former bed is falling apart literally, I have actually reinforced it with lumber from Home D…

She thinks they were gifts to 'US' instead of just me. I can't say I would argue that they weren't to 'US' but if they knew what was happening now they would definitely have feelings one way or the other and would re-stipulate that they were to me. It's electro-plated stuff - my family has never been rich so I doubt it is really worth much outside of it's age (maybe over 100 years old). These things were wedding presents to my grandparents when they married almost 70 years ago.

Plus she's a CPA. Acting unethically is not looked upon well in her profession.

I'm not going into reactive mode at the moment right now because her withdrawing money and investing it without an agreement about the money in place is kind of lame and I believe it would be seen unfavorably in court. Me agreeing to this situation however would be $10k I'm allowing her to steal. It would harden my case with other money though and I would need some flexibility in some other areas to be realized as well. The verbal agreements around the money in her accounts were witnessed by the…

Yes, I know the lawyers will get expensive. It's $500/hr for the one I've been using. I am weighing if I should just go ahead and retain her. The mediator is $300/hr. STBX asked me to be more collaborative with the mediator and then she comes back with this that her money is hers and not community property. It is absolutely community property and I never agreed otherwise. I was very generous about it when she was moving out and setting up her apartment. She took the TV and agreed I could replace…

My lawyer seemed to think the inheritance was pretty safely mine. The money did go into a joint account but that’s the only kind of account we had at the time. The money was never spent and the account never went below the amount deposited for the inheritance. It’s traceable as described in the judges guide. It might not be worth fighting over to be honest but shes created a shitty situation again. Obviously she can’t be trusted...

One of the main reasons I want to keep my kids in their family home is because I don't want them to lose their schools. Housing where we live is very expensive and inventory is rather low. Buying something else here wouldn't really be possible with having to split the cost with her but buying her out might be more plausible. I'm just exploring it to see what's possible - wanted to see if there was something I wasn't really thinking of.

Looking through your story and it's hard to believe. Yours so far is worse than mine but mine could easily get as bad. We're getting ready to start the separation negotiations... Getting involved with other people is a deal breaker for me - if she wants to go date then it's divorce not separation we're talking about.

She cheated on me, she doesn’t deserve spousal support. I’m perfectly happy to support my children.

The state calculator has me at about $1000 per month for the two kids. I'm more concerned with spousal support.

What if the AP is in another state where AoA suits are allowed but you are not in that state?

You can kill a man, but you can't kill an idea.
