You're correct that Valame did use the 5th amendment as a secondary argument in his lawsuit but the federal court unfortunately denied it by using the excuse that the federal court not being able to overturn Rostker. Yes i am well aware of the Valame case as i was also following that case too just like i was following the NCFM case to see if anything would come of this case. Although in the Valame case i was almost certain it would unfortunately be rejected you are correct that Valame definitely had Standing since he lost a federal job offer for not being registered for the sexist all male draft however that was not the reason they declined to hear his case. If you look back at the October court hearing last year with Nadine Lewis in the 9th district court of appeals the judges were all very persistent about the lack of injury since all the plaintiffs were already registered. There have been many complaints against the automatic registration from prominent privacy groups like the Electronic privacy information center(EPIC) which could help since they can potentially be willing to file amicus briefs on a new NCFM case if the NCFM decide to file a brand new lawsuit against the automatic registration. You should really try to talk to them as soon as possible to discuss the next steps such as finding a plaintiff that is not registered for the NCFM can either refile before the deadline ends for the supreme court case or to refile one as soon as possible to get it to a federal judge to order a stay(pause) on the automatic registration! Although the men that were plaintiffs in the 2021 were registered just like the men that are plaintiffs in the current lawsuit, the biggest difference was that the appeals court did not rule that there was no harm to them in the 2021 like they did in the current case! A pre-enforcement challenge is a lawsuit that is brought up to stop or challenge a law before it is enforced. If i were the NCFM i would file another lawsuit ASAP but this time against the discriminatory automatic registration that is set to kick off in December!
