| 3 | Well then...Except that he first said something to her, and then kicked her while she was already on the ground. This is most likely where it gets kind of murky as to wether it is still heat of the moment or a deliberate action. While this girl was clearly in the wrong and should be punished by school, I do think that this kick afterwards was unnecessary use of force which also should be punished.
