HR first would likely be best. The more of a paper trail you have and documentation regarding the several instances will be more useful later if/when you have to report her to a different superior

Woman's choice. Unless they get married, likely the woman will get a court order compelling him to pay child support for the next 18 years (19.5 if the kid goes to college) But the man can demand joint custody/parenting time to lessen the amount per month. Source: im a lawyer in Michigan
