I have no idea how they qualify it but in the Netherlands some cities pay for prostitutes (technically nurse/caregivers of sorts) to sexually stimulate the disabled. I would imagine it has to do with IQ. If the person has the capacity of a 6 year old, sex would probably be weird on both ends. If the person is capable of asking for sex, and knowing what sex is, I don't see why it would be an issue. I'm not sure about the law but I would even argue that they shouldn't prosecute if the sex involves someone between 14-16, as long as the other partner is no more than 2-3 years older.
