You do need to make above a certain amount - and I agree on the garnishment and judgement thing, but people are kinda assuming this person will be in a position where they make enough money that the garnishment will pay for all of the legal fees and damages in a lifetime. I've been there, it's not such a black and white path as people make it out to be. Our legal system is a mess, so the people who come out on top are the lawyers, not the people in most cases.

That's not how it works. You aren't going to sue a person in court, in the US, who has no income, and magically get all of your attorney fees back. If you were going after a tenant with a lease that stipulates that, then would be a different story. EVEN if you got the judge to agree, you still need to collect against future wages. That means you need to bring her ass back to court in what, 10 years time? Unless she's killing it, this is a crapshoot. You are better off taking that money you'd spe…

Good luck doing that in court. You will spend more money on legal fees that you will ever recover from damages.

I wish it was that easy in the US. Would be great.

You will likely not recover any attorney fees, making this a moot point. The lawyers will win and you will just end up paying out of pocket for legal fees for maybe a chance to recover damages in the future, except you will have to bring her back to court to collect. It sucks, you don't want to go down that road. I'm not advocating for her at all, but just trying to be realistic. https://www.investopedia.com/terms/j/judgment-proof.asp

If that was possible, they wouldn't be judgement proof.

If she was a minor you could sue the parents. She's judgement proof because she has no income.

True but won’t pay the legal bills. I’m sure a 19 year old is judgement proof too tbh.

This is probably the best part of the story...Misdemeanor to Felony in one easy step. The Oct. 1 incident now has the women — 20-year-old Lashae Whitaker and 28-year-old Tiera Brown — facing felony assault charges. The city police department's Internal Affairs Division is also reviewing the case.

Eh I think EBT folks pretty much do. They blow their EBT card in a few days.

You can kill a man, but you can't kill an idea.
