Like any contact, a judge has the authority to throw it out if it violates contract law if someone brings that to the court and proves it.

Well, if you post-nup is not a separation agreement, I have to disagree with your lawyer. Not my law firm, but I agree with this post from a well-respected firm in Greensboro. https://www.woodrufflawfirm.com/post-nuptial-agreements.html It is true that property division does not have to be equal or even equitable.

Just saw this post from David Neagle: https://davidneagle.com/shamed-and-guilted/. I enjoy his podcast but haven’t listened to this one yet. Maybe there is something there to help you with your feelings.

Explore what is causing the fear and guilt. Odds are your subconscious mind is trying to make you stay in something familiar even if it isn’t what you desire. Divorce can be hell as the other post said, but living a life you don’t want to live can be worse for some people.

Going to completely depend on your state. In North Carolina, you cannot address alimony if you aren’t separating, but you can have a consensual open marriage. Go figure!

Depends on several factors such as is your divorce final or not.

Have the house valued before the mediation instead of having to speculate about market value. And cash is king. Don’t give away your investments or retirement to keep a house.

You can kill a man, but you can't kill an idea.
