The strategy of “don’t move out” frequently advocated for in this sub really only applies to an owned home or if kids are involved. If you’re not on the new lease, and you shouldn’t be, getting your own place sounds like the healthiest thing for your sobriety.

If she pays you out from other sources, such as her parents, she ends up with a smaller loan payment on the new loan. So I don’t think there’s any benefit for you, just for her. She doesn’t want to refinance because rates are terrible right now and she’ll end up with a higher rate. Do NOT let her leave you on the current loan. Just make sure all the financial details are described in excruciating detail in your settlement agreement.

You need to get your name off the deed AND the loan. Getting off the deed isn’t too big of a deal. Getting off the loan is virtually impossible; no bank wants to let someone off the hook for a loan, hence the need to refinance. Do NOT agree to not refinancing, the bank can come after you if she defaults on the loan.

It’s going to feel unfair, you’re going to feel like you’ve been taken to the cleaners. You’re going to lose a lot of what you feel is yours and that you’ve built. You need to mentally square with that and accept it, move on, and make a plan to rebuild financially. Marriage is a state enforced financial contract where the person with the least income and assets wins. Keep that in the front of your mind if you ever consider marrying again.

If you care about her as a person and you care about your kids, don’t surprise her with divorce. Good communication is key, explain why the marriage will no longer work for you. Maybe you can go your separate ways amicably. People change or come into who they are; relationships run their course. Don’t drag her and the kids through a hostile divorce if you don’t have to.
