The first amendment does not protect threats either, accompanied with the fact that they implied they were going to commit a terrorist attack after claiming to be apart of a terrorist organization. The law WILL use that tweet to show you IMPLIED you were going to commit an illegal act/you intended to commit an illegal act. You don't have to explicitly say you're going to do something illegal for it to be illegal.
