I didn't. It came down to getting the charge expunged from my record or being able to sue her. By expunging my record, I lose my right to sue the state or the plaintiff. It was bullshit, but the charge being on my record was fucking with my life.

I know everyone else has said it, but lawyer up. I dealt with a similar scenario last year. I cant stress how important it is, no matter your innocence, that you get a lawyer. Also, start collecting any evidence you have (texts or emails from her if you have any) as well as witnesses. Talk to people from that night. I'm not sure it's actually worthy of an entire thread of its own, but when my lawyer told me he used this defense, I was astounded. That's another thing! I'm not sure if it varies state by state, but in MD, felonies are automatically sent to Circuit Court and tried in front of a Jury of your peers. If this isn't the case, I would highly recommend telling your friends to ask for a jury trial. I've heard different things, but they all boiled down to the state would offer me a deal of so much a day from how long I was in jail (I've heard anywhere from $110 a day to $660 a day), plus loss of wages. I'm still employed, thankfully. I work for and with the most amazing people in the world. They held my job and offered assistance to my friends and family in any way they could. According to my lawyer, once it's expunged, it's no longer public record. The only people who will be able to see it in the future are law enforcement agencies, and judges. Basically, anyone who would be involved in any future criminal cases -- which, hopefully, I will not be having.

I'm not sure, exactly, the legality behind having to wait three years to expunge it if I decide to sue. I'd imagine it's, mostly, due to the case being tied up in a lawsuit. But, having to waive the rights to sue is one of the things I have to sign off on on the expungement (is that a word?) paperwork that was given to me by the court's clerk office. Fortunately, my boss is a fucking champ. I didn't lose my job. They want me to be tempted to waive my rights to sue, so that they can avoid a potentially heavy lawsuit. It's shitty. It's unfair. It's not justice. And it's half the reason I want to fight it.

I will. To be honest, future employers aren't my biggest worry. I'm assuming that most competent H.R. employees would have enough sense when doing a background check to read the charges and see that they were dropped. if not, I can explain it to them, and tell them I'm going through a civil suit with the accuser, which is the only reason I haven't had them expunged. I'm more worried about the charge being a quick google search away from anyone I meet who happens to want to look me up.

As someone who is currently going through a rape trial, I beg to differ. I hooked up with a girl while I was drunk (she had been drunk earlier, but had slept for quite some time and sobered considerably) and she changed her mind about having hooked up with me, and I'm currently going through the trial. I'm being charged with sexual offense because I "had sex with her when she was under the influence of alcohol." It's not just a policy at Universities.

Definitely plan on it. I've already been looking into both. I've been told that, traditionally, when charges are dropped/acquitted/you're found not guilty, and you did jail time, if you file a suit against the state, they will almost immediately offer you a deal of $110 per day you sat in there, plus loss of wages. Agreed. The judge I got for my bail review was, fortunately, a good one. He saw through the charges for what it really was. That's also why, despite the fact that he's expensive, I'm keeping the lawyer I have. He's got a great reputation here in Baltimore City, and he maintains a professional relationship with most of the city judges. I really, really wish it'd been that easy for me. I've still got court shit to deal with. I lost eight weeks worth of pay. I've already dropped $1.5k in lawyer fees, and I'll have to drop another $5k at least before all is said and done. It's rough. But I have faith that justice will reign triumphant and my name will be cleared, and I'll be able to go after her for retribution financially. I hope, at least.

I hate to, because I've been working on it for almost 8 months now (I was going for the yeard challenge). But, I don't want to take any chances.
