5	Ray McDonald (NFL) will sue the woman who accused him of rape (for possibly costing him his career) I presume it would be defamation. There is also a possible malicious prosecution cause of action. Good for him. This is exactly what should be done. She must have been all over him on the video. The problem is that if it is clear that she is drunk then the tape might sink him. It really is unconstitutional to make the defendant prove that they did not rape some. The principles of criminal law are the opposite. It is that the prosecution/crown must prove that a crime was committed. Also what evidence would a man put forward. He would say I asked for and received consent prior to every step/escalation of intimacy and the lady will deny it. We are left with good old fashioned he said vs she said.
