If there is a 'Finding of Fact' hearing the accuser makes out a table of allegations (a 'Scott Schedule') and each one is tested in a trial - both presenting evidence and being cross examined. A court will then decide if it's more likely to have happened than not (or vice versa). There's nothing to stop people agreeing to a pre nup that includes inherited assets and properry being included in one.
