Workers compensation is an exclusive remedy (very politely suggest a quick Google because it's a really seldom discussed topic, exclusive remedy) He was injured during the course and scope of his employment. That's 100% work comp territory and even if the claim was denied initially, it still would only be in the jurisdiction of the local states workers compensation appeals board WCAB.
