To be fair, "too drunk to consent" does exist outside sexual activity as well (at least in Canada, not sure if it is different in the States). For example, I worked at a casino and we had to give drunk people the boot because if we allowed them to gamble while visibly intoxicated, they could sue (and would win) to get their losses back.
