My understanding is that the database that was used to catch the Golden State Killer are public and available to law enforcement as well as to the general public. Honestly a little sorry for a lawyer so desperate to file this action. The Bar (drinking, not lawyer group) should file a motion to have the woman and her lawyer pay their legal fees for having to respond to this BS. A little legal accountability would be appreciated, and in my State, the law that allows a party to demand their fees for this kind of foolishness is called a “legal accountability act.”

He beat the shit out of another kid when he was in high school. It was a very serious beating, police were called, and jail was a legitimate possibility. My recollection was that it started because two groups of kids from rival schools went to the same place for prom. The other guy still had nothing good to say about Tillman after he was killed, but was polite enough (and perhaps also wise and cautious enough) not to bring it up or discuss it with the media.

No one explains that to you unless you go to law school or become a cop. A threat is the assault, and it become also a battery if there is unwanted touching (like getting punched in the face). The difference between civil and criminal assault, as I recall, is that it is criminal assault only if the defendant had the means to carry out the threat. If they’re threatening you but couldn’t actually pull it off in reality, then you can sue them but they won’t be going to jail.

While there are numerous instances of bad cops flouting the Constitution, I am old enough to have cop friends and respect for 90% of the people doing that difficult and dangerous job. What really appalls me these days is that the good cops do not kick the bad ones out, but stand firmly behind the “thin blue line” and the police union. It’s a small percentage of cops who make the vast majority look bad, whereas with lawyers, it’s the 99% of us who make the other ones look bad. 🤣

The fact that it’s a car is 99% of the way to probable cause under current 4th Amendment interpretation. There’s no warrant needed and this has been the law since Carroll v. US decided in 1925. And yes, that was a bootlegging case. The National Prohibition Act allowed warrantless searches of vehicles, boats, or airplanes when police had reason to believe illegal liquor was being transported. Yet another reason Prohibition was idiotic, and remains idiotic today.

I’m a Libertarian but I’m also a lawyer and once you put something in a car, the cops can seize it and use it as evidence against you. Yes, the 4th Amendment should be better-supported, but under current Constitutional interpretation, this was a perfectly legitimate request by the officer, and the contraband can and will be used as evidence.
