In Texas for separate property, first you will need to prove that this is in fact separate property… which you would be easy in your case from the sounds of it.. which means she wouldn’t be eligible for 50% of the equity.. howler if you paid for the mortgage during the time you were married.. then likly she would be entitled to 1/2 of the principal paid on the note during that period of time since those payments were made using community funds. Clearly if you move away.. you will loose 50/50 and joint conservertoship… or how ever you spell it.. a major capitulation of parental rights.. on top of not seeing your son frequently… you will almost be certain to pay standard child support costs as opposed to what ever deal you have now…. This is a terrible idea on many levels.

Check out meetup a site that list meetings of people doing all sorts of things.. yoga, rock climbing, brewery, whatever. Find a group go meet people. Woodworking is fun and it is possible to make money.. maybe. Build and custom corn hole or outdoor furniture. Tons of ideas online for builds that require minimal tools.

Sounds like some sort of scare tactic. This type emotional terrorism is a common abuse tactic to simply get their way.. was their some sort of recent conflict? If so the it is likely she is using this as tactic. You should take this as an extreme red flag of Course that you are married to an ill person. The crisis may pass or it may end in an immediate filing… either way your next step should be to contact an attorney.. do not wait. Do it.

It may be your only leverage is to threat to take the thing to court if she can’t settle.. Paint a picture of her lawyers fees she will have to pay and how you will gladly drag the whole thing out even if it means you only have a chance at being an equal co-parent. Threatening divorce is emotional terrorism. Get divorced, No kids and you y’all already agree on property split.. go down to the court house and ask for the pro se packet.. may as well pick one up for the misses while you are there. She will think you are so thoughtful if you do. You both fill out the packets and make sure they agree and match. Then go submit them.. usually from filing date you need to wait 1-3 months before a judge will sign the thing.

Do you have children? If no... Then it's not any different for you. Devoice / family law varies depending primarily on state or country where you reside. In Texas it would be up to her to prove that the house is separate property, and that community funds were not used for the purchase and/or used to pay the mortgage. Pls get yourself a lawyer. She almost certainly won't respect your rights as a parent, and don't be surprised when she has a lawyer defending her. If you are separated and having to discuss custody agreements, then you are already in the middle of the divorce process. Same, I am playing near full child support, but I get my kiddo 50% of the time. I had no choice but to negociate. In Texas if you go to court, the judge does not even have the option to award 50/50. So both parents have to go for primary and the standard 60/40. As part of my deal I did get her to agree that I claim the child tax credit every year. So that helps a bit.

If her name is on the title, then the house is probably going to be considered 100% community property meaning 50/50 split of the equity. If not the the property could be considered separate property. But you would have to prove separate property. In which case she could file for reimbursement of community funds used to pay the mortgage on the separate property. Usually this means 50% of the pricple paid down during the marriage. In my case the value came out to 15k or so.

Play it up as much as you can with out being dishonest. This can help you in a negotiation, but maybe let her fuck up like this again. if you think this is heading to court.. a second or third incident involving police reports with her as the bad actor can only help you in a custody case. If she is smart she will realize she just gave you some ammo.. if she is not smart.. she will do it again.

Is your name on the title of the house? If so..it should be considered community propriety.. and as such you are entitled to half the equity in the house. If your are not on the title.. she would still have to prove the house as separate property, meaning she would have to prove the downpayment was made from her own seperate funds. If she cant prove separate property, then you are entitled to half. If she can prove separate property, then you can still ask for a reimbursement of community funds …

Being that the kid is so young a 50/50 maybe tough. As i understand it 50/50 is really only feasible in the eyes of most courts after 3yrs of age... In terms of dating... i am sure you will get dates... maybe not with everyone you want, but thats probably true with or with out the kiddo. Next time before you marry try and make sure its the right one and the right thing for you. Personally, i dont think i will ever do it again. There is next to zero bennifit.
