Social habits and customs, as well as a host of cognitive biases, make it hard to say when opportunity is actually equal. Equality under the law isn't always enough, which is especially true if the law is applied discriminatory. See blacks on death row as a prime example. If they argued policy or even personality, fine, but when the argument was purely the gender of the person, that's a very different matter.
