Well, that's not really what we're talking about though. Even if the governments do have telco's fork off all voice and data content for every device (which they may well do - technically it would be a very simple procedure), they are not going to access that illegally obtained content to assist some schmo beat a rape allegation. Doing that would almost certainly defeat the purpose.

TelCo's do not maintain anything more than metadata relating to SMS/MMS any more than they do phone calls. For a telco to actually retain SMS/MMS content, they would need a warrant, just exactly as they would with voice calls. I can guarantee you that this is the case in the U.K. New Zealand and Australia, and I am quietly confident that it is the same within the USA and Canada. Retaining any SMS/MMS data (above and beyond metadata) would be the same breach of privacy as voice recording.
