I kinda agree, most judges follow the jurisprudence (previous cases ruling) on the matter. I.e. "the mother is better for the children/think of the children" In this case, it is part of it. BUT using "common sense" is not the default mode on most judges. In this case, the evidence is against the mother. But the judge doesn't want to acknowledge this. Sorry I'm late for the discussion, but as a non-facebook user, did her wife STILL has him as a friend? Isn't the same as if some one is banned from shouting on the streets that (e.g.) "my wife is a whore", even when her wife isn't across the street?
