I agree 100% that the defense itself is not a pussypass but a legal one. However, if the defense is successful, that will most likely be viewed as a pussypass, particularly if the legal defense was not that strong but she prevailed anyway because judge or jury were swayed by her. Could go the other way though and judge/jury could make an example out of a bad person who pushed their entitlement too far.
