Single party consent only applies when the person doesn’t have a reasonable expectation of privacy. While being in public is usually a good reason to argue they had no reason to expect that they didn’t have a reasonable expectation of privacy, being in a bedroom and engaged in the act of sex is a good reason to have that expectation.
