5	Men aren't walking penises? I think what was implied is that you can rape someone via a bad choice. Washington State Law states that if one or both parties are drunk that consent cannot be given. Lets say that the man and woman are drunk. Both want to have sex. They wake up in the morning and one decide that they only did it because they were drunk. I believe it falls under sexual assault but criminal charges can be brought against the offending party.
