That's not the legal system at work though. That's a school district policy. And it's obviously not the case in most places, and likely a tactic to prove to you that it is a big deal. It's rooted in truth, but obviously not a true statement.

I doubt that your teachers will physically restrain and hold back violent high-schoolers either, for fear of being hurt or sued. And I bet there are schools wherever you are that have the same thing pop up occasionally. That said, it's ridiculous and the kids need some strict discipline immediately, up to expulsion if the behaviour can't be quelled. I've seen behaviour like daily this when we moved to a new state, and somehow our middle-class home was on a little finger that jutted into a school…

What? Impacting her life in a positive way that will last a lot longer then 30 days in jail? What's wrong with that? I'm more than okay with financial punishment and restriction of certain rights. I just don't believe anyone committing a non-violent crime needs to be locked up. It's hard to imagine on a small scale, case by case basis, but obviously things need to change.

Yes. It would be safer for all parties involved, establish a positive community relationship, and guarantee that she is punished only for what she has actually done. If her physically harming someone isn't eminent, then physically harming her should not be considered an option. Not only should it not be an option, escalation should be avoided, unlike in this situation.
