In most jurisdictions the house would be a premarital asset, but your wife will still have claim to half the increase in value since marriage. Also any money she can prove she spent on upkeep or renovations. You’ll have to check with your lawyer to see if this holds in Vermont.

Unless you’re using that year to put yourself in the best position to file you’re likely wasting your time. Consult with a lawyer, get your ducks in a row and file. Based on her reaction maybe you tell she has until it’s final to convince you that she’s willing to do her part to save the marriage, but I doubt that conversation will be necessary.

Your needs don’t align because you need to be monogamous and she needs attention from other men and is more than willing to cheat to get it. She’s not going to change, and in many jurisdictions the longer the marriage the more alimony you will owe. You’re improving your own cage. You need to establish paternity as soon as possible for a couple of reasons. If the child isn’t yours you don’t want to pay child support for the next eighteen years. If the child is yours you want to claim your paternal rights. The likelihood of her new man sticking around through her pregnancy to raise someone else’s kid isn’t exactly a high probability. She’s telling him it’s his.

North Carolina still recognizes at fault for adultery. Most places that do it’s usually not pursued because it takes longer and means more legal fees. But some places where it’s recognized it removes the waiting period. Check with your lawyer.

She’s a serial cheater. There’s something broken inside her and this is how she copes. She’s not going to change until she puts in the work to change. Start the divorce and watch her actions. If it was me I’d go through with the divorce and tell her reconciliation is a possibility once it’s done, but the divorce is happening as a consequence of her constant cheating. If she can’t accept that with some humility and grace then you have your answer.

Blame shifting is definitely not remorse. Sounds like she’s sorry she got caught, not for having an affair. To put it nicely, she’s not been using the separation to work on herself and find out why she made those choices. If she doesn’t fix herself you’re just signing up for the same ride.

To include finding out about emotional (maybe physical?) infidelity on her part. Has she done everything she can to come clean about her affair? Showed you all the messages, photos she sent? Written a timeline and offered to verify with a polygraph? A true demonstration of remorse would be her doing everything possible to make sure you know what you’re being asked to forgive, even if she thinks it would end any chance of reconciliation.

It sounds like she’s filing for it so any time he can’t watch the kids himself (business travel) he would have to offer her the option of looking after them. Once this happens a few times she documents it and her lawyer tells the court that the actual time the kids spend with her exceeds the custody agreement and presto bingo more child support.

Check with the counselor on their views on infidelity before the appointment. Many MC’s are worse than useless when it comes to infidelity. And by worse than useless I mean they can actually add to the damage. Ask them who is responsible for infidelity. If their answer is anything besides the cheater cancel the appointment.
