Please do not get married right now. I do not know how old you are. But you do not appear to be ready for marriage just yet. Please know that I am not suggesting that you are right or wrong in attempting to quantify an important aspect of a marriage. “Lifetime” and “permanent” support are often misunderstood. Look into the following: 1. Gavron Warning 2. Seek work order 3. Marriage of Alter 4. Vocational assessment 5. Income imputation 6. Cohabitation 7. 4320 Factors 8. Change of circumstances for either/both of you. That’s a very short list. I’m just trying to give you some pointers. Hope this helps.

Short answer: No, she cannot. Longer/Infuriating Lawyer Answer: She might be able to get the house if she is able to prove that you have other assets valued the same or more than the house which she cannot reach because of jurisdictional issues. Example: you have a million dollar home in California and you have also purchased and disappeared a million dollars worth of gold bricks. Yes. At a minimum, do a consultation. I recommend doing a paid consultation (rather than a free one) so you can get actual direction rather than a sales pitch. Depending on where you live and when you were served, you may be about to default. So, speak to an attorney ASAP.

I can answer this based on why it is done in California, and maybe it will help explain things: A petition sets the outer limits of what you can ask for. Say something happens between now and the end of the case which causes you to want sole custody, then you would have to “seek leave” to “amend” your petition. I see this all the time in my line of work. I’m not a psychologist so I don’t know the underlying cause. But what people have specifically said to me is that they had a lot of interests before they got married; that they had gotten out of touch with their interests; that they were trying to find themselves; and so on. The common theme is that they blame the other side for diminishing them as a person and they are trying to be who they thought they used to be or to be someone new entirely.

The best way to find an attorney is through friends and family. People at work can be a good resource as well. This is because because an attorney who has assisted someone else working for the same employer already has familiarity with your paychecks, the benefits, etc. Having said that, most of my clients find me on the Internet. (The remainder are referrals from existing or past clients.)
