Ask any off-duty police officer, judge, prosecuting attorney,or defense attorney what they would do in the same situation. BTW, this advice is what my own defense attorney told me after I was accused of a crime that I didn't commit.

Just know that their purpose is build up a case (against whomever they question). If you're innocent, let them come to that conclusion by their lack of evidence. If you speak to them, whatever you say can BECOME evidence.

They said they doubt that there will be a formal case ... cops lie. Tell him to not speak to ANYONE other than his retained attorney. Any innocuous statement he makes can be twisted by the police and/or a prosecuting attorney. Be supportive of your brother, but also don't rule out the possibility that he may have done something wrong. The people you least suspect can make very bad decisions.

my dad wasn't a swell guy and I don't want to risk beating/abusing my own offspring. That's not the kind of dad a kid needs. FYI, the kind of people who do beat and abuse their children, don't typically have that kind of introspection and concern. Get a paternity test after the baby is born, and approach this one step at a time.

well, my friends father is still alive (AFAIK), and like your grandfather, he would not fly on an airplane. His last flight was the one that brought him home after WWII. His son (my friend) lived in Indiana, and I only met his grandfather at the funeral. He drove here by himself (over 90 years old) from Florida!

that simply isn't true. Not even remotely close to being true, and the article suggests no such thing. It might be a little vague, but the whole 2 year (in certain states) limit is how long a father can go without contesting paternity. If it's not contested in that time, then you ARE the father.

I read the article, and your claim about "any single mother can point to a random guy .. if the child is over 2 years". A woman cannot just point to a random guy and say he's the father of her 3 year old. If a man has been raising a child for two years (whether he believes he's the father or not), then he's established paternity for that child. There's nothing at all random about that, other than the woman's sense of morality.

if the mother doesn't want to, you have no right to get one. yes you do. If she petitions the court claiming you to be the father of the child, a paternity test is one of the steps in establishing paternity.

yes, in all the cases you cite, be responsible for your sperm. Be 100% responsible for your sperm if you don't want to reproduce. Same goes for women and their ovaries. I would hope that any women who is told "Don't worry, I've had a vasectomy" would be as skeptical as a man who's told "Don't worry, I'm on the pill / Don't worry, I can't have kids / Don't worry, I'm not ovulating" If you're tricked into raising someone else's kids, that's a completely different situation.

how do you think this would have played out if he didn't video tape the encounter? It's not as though he was fingered as the rapist, and then someone else was proven to be the rapist. That would have been "mistaken rape accusation". The rape was fictional, and it would have become a reality for this guy had he not video taped her consent.
