I agree. However in a legal sense there's definitely a problem when identical behaviors elicit grossly disparate responses depending on the subjective feelings of the individual. The classic example is an ugly male co-worker flirting with a woman vs a handsome male co-worker. One can be "sexual harassment" while the other is "charming."
