This is grossly misinterpreted. They cannot use alcohol as the reasoning for the rape. Ie “I was drunk so I couldn’t consent” when they where actually saying yes. This doesn’t apply to “ I was drunk but said no” neither sex gets a free pass because the victim was drunk. Seems like they are separating being black out drunk with ingesting drugs or alcohol. Currently if it ingest any amount it is legally considered rape. But there are many times where quite frankly the level of impairment can still give consent but the law didn’t recognize it. For example if you have one beer you can consent, you can drive etc.. but the law says you cannot consent due to that one beer. Also for instances where both parties are drunk and the man is the rapist because he’s the man.
